| Description: | The author analyzes the procedure for pre-trial appeal of decisions of the state registration authority within the framework of the procedure for state registration of a legal entity. Points out the inconsistency of the main provisions of the legislation on state registration concerning the forms of protection of the rights and legitimate interests of applicants. Comes to the conclusion that the established approaches to the protection of their interests cannot be recognized as fully optimal. Suggests the main directions for the development of legal regulation of registration actions and makes specific proposals for changing the legislation. Автор анализирует порядок досудебного обжалования решений государственного регистрирующего органа в рамках процедуры государственной регистрации юридического лица. Указывает на рассогласованность основных положений законодательства о государственной регистрации, касающихся форм защиты прав и законных интересов заявителей. Приходит к выводу о том, что сложившиеся подходы к защите их интересов нельзя признать в полной мере оптимальными. Предлагает основные направления развития правового регулирования регистрационных действий и дает конкретные предложения по изменению законодательства. |
