| Περιγραφή: | Relevance: currently, issues of ensuring the economic security of the Russian Federation, including in the field of subsoil use as one of the priority areas of activity of the internal affairs bodies, are of particular importance. Problem statement: an illegal market of semi-precious stones, precious stones and precious metals continues to exist and function on the territory of the Russian Federation, which is characterized by constantly developing and improving illegal infrastructure, methods of illegal extraction, processing and sale, as well as concealment of traces of illegal activity. Thus, according to the study of practice, every year employees of the Ministry of Internal Affairs of the Russian Federation withdraw only amber worth over 1.3 billion rubles from illegal circulation. An analysis of the activities of the operational units of the internal affairs bodies in the direction under consideration indicates an insufficient level of detection and disclosure of illegal trafficking in semiprecious stones, an unsatisfactory quality of the investigation of crimes of the category under consideration. The purpose of the study: to obtain scientific knowledge about the state of operational and investigative counteraction to illegal trafficking of semiprecious stones. Research methods: the use of general scientific and special methods of collecting and processing information. The research was based on a dialectical methodology that reveals the unity of the object in its complex diverse manifestations. Cognition of the essence and regularities of the activity under consideration was carried out from the standpoint of a systematic approach that allows revealing complex relationships between the structural elements of the studied subject. The methodological principles of the article were the general scientific principles of objectivity and historicism, following which ensured obtaining reliable knowledge about the subject of research due to the comprehensiveness of its study in development, taking into account the interrelations and interactions with other objects and structures. Results and key conclusions: the article examines the state of operational and investigative counteraction to the illegal trafficking of semi-precious stones, suggests measures to improve the operational situation in this area of activity of the internal affairs bodies in order to increase the level of detection of the desired types of crimes; improve the organizational and tactical basis for countering these types of crimes. It is proposed to make changes to the current structure of the operational situation in the line of operational-investigative counteraction to illegal trafficking of semiprecious stones in terms of the characteristics of the state of turnover of semiprecious stones. The author's definition of the concept "operational-investigative counteraction to illegal trafficking of semiprecious stones" is given. The existence of a contradiction between the need to strengthen counteraction to illegal trafficking of semiprecious stones and the lack of scientifically sound recommendations for their elimination is substantiated. Актуальность: в настоящее время особую важность представляют вопросы обеспечения экономической безопасности Российской федерации, в том числе в сфере недропользования как одного из приоритетных направлений деятельности органов внутренних дел. Постановка проблемы: на территории Российской Федерации продолжает существовать и функционировать нелегальный рынок полудрагоценных, драгоценных камней и драгоценных металлов, которому присущи постоянно развивающиеся и совершенствующиеся нелегальная инфраструктура, способы незаконной добычи, переработки и реализации, а также сокрытия следов противоправной деятельности. Так, по данным изучения практики ежегодно сотрудниками Министерства внутренних дел Российской Федерации из нелегального оборота изымается только янтаря на сумму свыше 1,3 млрд руб. Анализ деятельности оперативных подразделений органов внутренних дел в рассматриваемом направлении указывает на недостаточный уровень выявления и раскрываемости незаконного оборота полудрагоценных камней, неудовлетворительное качество расследования преступлений рассматриваемой категории. Цель исследования: получение научных знаний о состоянии оперативно-розыскного противодействия незаконному обороту полудрагоценных камней. Методы исследования: использование общенаучных и специальных методов сбора и обработки информации. Исследование опиралось на диалектическую методологию, раскрывающую единство объекта в его сложных многообразных проявлениях. Познание сущности и закономерностей рассматриваемой деятельности осуществлялось с позиций системного подхода, позволяющего раскрывать сложные взаимосвязи между структурными элементами изучаемого предмета. Методологическими принципами статьи стали общенаучные принципы объективности и историзма, следование которым обеспечило получение достоверного знания о предмете исследования за счет всесторонности его изучения в развитии, с учетом взаимосвязей и взаимодействий с иными объектами и структурами. Результаты и ключевые выводы: в статье рассмотрено состояние оперативно-розыскного противодействия незаконному обороту полудрагоценных камней, предложены меры по улучшению оперативной обстановки в данном направлении деятельности органов внутренних дел в целях повышения уровня раскрываемости искомых видов преступлений; совершенствования организационной и тактической основы противодействия данным видам преступлений. Предложено внесение изменений в действующую структуру оперативной обстановки по линии оперативно-розыскного противодействия незаконному обороту полудрагоценных камней в части характеристики состояния оборота полудрагоценных камней. Дано авторское определение понятия «оперативно-розыскное противодействие незаконному обороту полудрагоценных камней». Обосновано наличие противоречия между потребностью в усилении противодействия незаконному обороту полудрагоценных камней и отсутствием научно обоснованных рекомендаций по их устранению. |
