| Description: | В работе исследуется вопрос толкования понятия «ведомственный процессуальный контроль». Анализируется ряд мнений ученых о том, какой содержательный смысл вкладывается в это понятие. На основе этого анализа автор выражает собственное мнение о значении устоявшегося и часто используемого в сфере уголовно-процессуальных отношений термина «ведомственный процессуальный контроль». Рассматривается также вопрос качества современного ведомственного процессуального контроля на примере материалов из следственной практики. Автор считает, что современный ведомственный процессуальный контроль не в должной мере отвечает требованиям, направленным на защиту прав и законных интересов лиц, вовлеченных в сферу уголовно-процессуальных отношений. На основе своего анализа автор приходит к выводу о необходимости осмысления существующих недостатков при производстве ведомственного процессуального контроля и необходимости выработки конкретных предложений по реформированию системы правоохранительных органов. По мнению автора, без такого реформирования ведомственный процессуальный контроль не станет эффективным инструментом, обеспечивающим соблюдение и защиту прав и законных интересов лиц, вовлеченных в сферу уголовно-процессуальных отношений. n the article, the author explores the question of the interpretation of the concept of the term departmental procedural control. Analyzes a number of positions expressed by scientists about what meaningful meaning is put into the term departmental procedural control, and based on this analysis, expresses his own opinion about the meaning of the term "departmental procedural control", which is well-established and often used in the field of criminal procedural relations. The article also examines the issue of the quality of modern departmental procedural control on the example of materials from investigative practice. Taking into account the above examples, the author expresses the opinion that modern departmental procedural control does not adequately meet the requirements aimed at protecting the rights and legitimate interests of persons involved in the sphere of criminal procedural relations. Based on his analysis, the author comes to the conclusion that it is necessary to comprehend the existing shortcomings in the production of departmental procedural control and the need to develop specific proposals for reforming the system of law enforcement agencies. According to the author, without such a reform, departmental procedural control will not become an effective tool ensuring compliance with and protection of the rights and legitimate interests of persons involved in the sphere of criminal procedural relations. |
