Περιγραφή: Статья посвящена раскрытию особенностей судейского усмотрения и его пределов. Рассматривается понятие судейского усмотрения и его нормативное закрепление в различных процессуальных нормативных правовых актах в условиях современного информационного общества, а также толкование этого понятия. Проведен анализ взаимосвязанности этого понятия с профессиональными и личностными качествами судьи, а также его отграничение от понятия судебной ошибки. Особое внимание уделяется определению пределов судейского усмотрения: несмотря на большую законодательную регламентацию, этот вопрос остается по-прежнему значимым и интересным для изучения. This work is devoted to the disclosure of the features of judicial discretion and its limits in particular. The article considers both the very concept of judicial discretion and its normative consolidation in various procedural legal acts in the conditions of the modern information society, as well as the interpretation of this concept. The analysis of the interconnection of this concept with the professional and personal qualities of a judge, as well as its delimitation from the concept of a miscarriage of justice is carried out. Also, special attention was paid to the determination of the limits of judicial discretion, despite the large legislative regulation, this issue also remains significant and interesting for study.
