| Description: | В статье с учетом теории, действующего законодательства и практики его применения дается уголовно-правовая характеристика некоторых составов преступлений против конституционных прав и свобод человека и гражданина, содержащихся в главе 19 Уголовного кодекса Российской Федерации. Особое внимание автор уделяет содержанию насилия, которое в анализируемых составах преступлений выступает в качества обязательного признака объективной стороны. Приводятся примеры из судебной практики и осуществляется их анализ. The article, taking into account the theory, the current legislation and the practice of its application, gives a criminal-legal description of some elements of crimes against the constitutional rights and freedoms of man and citizen contained in Chapter 19 of the Criminal Code of the Russian Federation. The author pays special attention to the content of violence, which in the analyzed elements of crime acts as a mandatory feature of the objective side. Examples from judicial practice are given and their analysis is carried out. |
