| Description: | В статье дается анализ изменений, внесенных в декабре 2020 года в действующее законодательство, регулирующее вопросы оплаты труда. Автор показал порядок установления МРОТ на основе медианной заработной платы; рассмотрел систему основных государственных гарантий заработной платы. Делается вывод, что величина МРОТ как правовое средство, обеспечивающее право работника на достойное для него и его семьи существование, становится государственной гарантией только при условии установления ее на всей территории России не ниже величины прожиточного минимума трудоспособного населения. В статье использованы материалы судебной практики; приводятся правовые позиции Конституционного Суда РФ относительно института минимального размера оплаты труда; раскрывается конституционно-правовой смысл отдельных статей Трудового кодекса РФ, регулирующих оплату труда. The article analyzes the changes made in December 2020 to the current legislation regulating the issues of remuneration of labor. The author showed the procedure for setting the minimum wage based on the median salary; considered the system of basic state guarantees of wages. It is concluded that the minimum wage as a legal means that ensures the right of an employee to a decent existence for him and his family becomes a state guarantee only if it is established throughout Russia not lower than the subsistence minimum of the working-age population. The article uses the materials of judicial practice; provides the legal positions of the Constitutional Court of the Russian Federation regarding the institution of the minimum wage; reveals the constitutional and legal meaning of certain articles of the Labor Code of the Russian Federation regulating labor remuneration. |
