| Description: | The restriction of visits to certain places provided for in Article 53 of the Russian Criminal Code (distances closer to them) is a good legal basis for protecting the rights of the victim: the judge can clarify the signs of such places, taking into account the fact that the victim is regularly there, provided that in this way the convict's ability to realize vital needs is not violated. The author refers to the position of Russian Constitutional Court, analyzes the institution of prohibition of certain actions, raises the question of supplementing the Criminal Code with a restriction on communication with the victim. It is noted that the existing restrictions are reasonably inapplicable to the relatives of the victim. Предусмотренное статьей 53 УК РФ ограничение посещения определенных мест (расстояния ближе к ним) являются неплохой правовой базой для защиты прав потерпевшего: судья может уточнить признаки таких мест с учетом того, что там регулярно находится потерпевший при условии, что таким образом не нарушаются возможности осужденного на реализацию именно жизненно важных потребностей. Автор ссылается на позицию Конституционного Суда РФ, анализирует институт запрета определенных действий, ставит вопрос о дополнении УК РФ ограничением на общение с потерпевшим. Отмечено, что существующие ограничения обоснованно неприменимы к близким лицам потерпевшего. |
