Περιγραφή: The article examines the state of intoxication as one of the types of circumstance aggravating the punishment. The attitude to this circumstance in the normative acts of Ancient Russia, the Russian Empire and the USSR is analyzed. The points of view concerning the inclusion of this circumstance in the general list of aggravating circumstances are given. Medical statistics are presented in defense of position on the need to recognize the state of alcoholic intoxication as an aggravating circumstance, regardless of the circumstance of the case.
В статье рассматривается состояние опьянения как один из видов обстоятельство, отягчающих наказание. Анализируется отношение к этому обстоятельству в нормативно актах Древней Руси, Российской Империи и СССР. Приводятся точки зрения, касающиеся включения данного обстоятельства в общий перечень отягчающих обстоятельств. Приводится медицинская статистика в защиту позиции о необходимости признания состояния алкогольного опьянения отягчающим обстоятельством вне зависимости от обстоятельств дела.
