| Περιγραφή: | Актуальность: становление многополярного мироустройства является комплексным фактором, оказывающим самое существенное воздействие на трансформацию российской правовой системы и, прежде всего, на правотворческий процесс. Экзистенциальные вызовы и угрозы российской государственности, которые во многом являются следствием активных действий России по противостоянию дальнейшему несправедливому однополярному развитию, требуют не только мобилизации внутренних ресурсов государства, но и изучения основных направлений и ключевых результатов их воздействия на правотворческий процесс в целом и действующее законодательство в частности. Постановка проблемы: несмотря на то, что именно становление многополярного мироустройства является наиболее значимой детерминантой трансформации российского право творчества, данная проблематика остается практически не изученной как на уровне общей теории права, так и отраслевых юридических наук. В настоящее время наблюдается значительное количество работ, связанных с влиянием глобализационных процессов на развитие правотворчества и других элементов правовой системы, что тем не менее не может компенсировать образовавшуюся исследовательскую нишу в силу очевидной причины: глобализация и переход к многополярному устройству – далеко не тождественные понятия. Цель исследования: обосновать важнейшее влияние, которое оказывает становление многополярного мира на трансформацию российского правотворчества и выделить ключевые направления (векторы) данной трансформации. Методы исследования: в работе были использованы как общенаучные, так и частнонаучные методы познания: диалектический, системно-структурный, функциональный, формально-юридический, сравнительно-правовой, метод правового моделирования и т. д. Необходимость глубокого анализа текстов нормативных правовых актов предопределила особое внимание к герменевтическому методу. Результаты и ключевые выводы: обосновывается авторская позиция, согласно которой современные тенденции развития российского правотворчества отражают эффективный подход его субъектов к защите национальных интересов государства, взвешенное противодействие агрессивной санкционной политике, интеграцию общества вокруг традиционных духовно-нравственных ценностей, социально обусловленную и неизбежную юридификацию российского общества, равно как и эволюцию самой юридической техники правотворчества. Relevance: the formation of a multipolar world order is a complex factor that has the most significant impact on the transformation of the Russian legal system and, above all, on the law-making process. Existential challenges and threats to Russian statehood, which are largely the result of Russia’s active actions to counter further unfair unipolar development, require not only the mobilization of internal resources of the state, but also the study of the main directions and key results of their impact on the law-making process in general and the current legislation in particular. Problem statement: despite the fact that it is the formation of a multipolar world order that is the most significant determinant of the transformation of Russian lawmaking, this issue remains practically unexplored both at the level of general theory of law and branch legal sciences. Currently, there is a significant amount of work related to the influence of globalization processes on the development of lawmaking and other elements of the legal system, which nevertheless cannot compensate for the research niche that has formed for an obvious reason: globalization and the transition to a multipolar system are far from identical concepts. The purpose of the study is to substantiate the most important influence that the formation of a multipolar world has on the transformation of Russian lawmaking and to identify the key directions (vectors) of this transformation. Research methods: both general scientific and private scientific methods of cognition were used in the work: dialectical, system-structural, functional, formal-legal, comparative-legal, legal modeling method, etc. The need for in-depth analysis of the texts of normative legal acts predetermined special attention to the hermeneutic method. Results and key conclusions: the author’s position is substantiated, according to which modern trends in the development of Russian lawmaking reflect the effective approach of its subjects to protecting the national interests of the state, balanced opposition to aggressive sanctions policy, the integration of society around traditional spiritual and moral values, the socially conditioned and inevitable legitimization of Russian society, as well as the evolution of the legal technology of lawmaking itself. |
