Περιγραφή: Основываясь на научной доктрине, а также на уголовном, административном, арбитражном и гражданском процессуальном законодательстве, авторы рассматривают понятие «справедливость» и делают вывод о необходимости единообразия в понимании данной категории. Авторы приводят основные точки зрения относительно понятия «справедливость». Опираясь на определение понятия «справедливость» в юридической энциклопедии, они приходят к выводу о том, что справедливость в юриспруденции необходимо понимать в первую очередь как правовую категорию. Обращаясь к положениям УПК РФ, АПК РФ, КАС РФ и ГПК РФ, авторы отмечают различное использование категории «справедливость» в терминологии процессуальных кодексов, в связи с чем делают вывод о необходимости унификации использования данного понятия в процессуальном законодательстве. Based on scientific doctrine, as well as on criminal, administrative, arbitration and civil procedural legislation, the authors consider the concept of «justice» and conclude that there is a need for uniformity in understanding this category. The article contains the authors' main points of view that relate to the concept of «justice». Further, referring to the legal encyclopedia and starting from the definition contained in it, the authors come to the conclusion that justice in jurisprudence must be understood primarily as a legal category. Further, referring to the Code of Criminal Procedure of the Russian Federation, the Arbitration Procedure Code of the Russian Federation, the Code of Administrative Procedure of the Russian Federation and the Code of Civil Procedure of the Russian Federation, the authors note the different use of «justice» in legal terminology, and therefore conclude that it is necessary to unify the use of this concept in procedural legislation.
