| Description: | Рассматриваются проблемы обеспечения законности при применении мер административного принуждения. Данная проблема является одной из самых важных, поскольку в ходе применении мер административного принуждения осуществляется ограничение прав граждан. Административное принуждение должно осуществляться только при наличии соответствующих оснований, что отчасти является гарантий соблюдения требований законности. При применении мер административного принуждения важную роль играет соотношение принципов законности и целесообразности. Законность как принцип применения мер административного принуждения, с одной стороны, объединяет в себе иные принципы применения мер принуждения, а с другой стороны, действие принципа законности не должно подменять работу других принципов. The problems of ensuring legality in the application of administrative coercive measures are considered. This problem is one of the most important, since in the course of applying administrative coercive measures, the rights of citizens are limited. Administrative coercion should be carried out only if there are appropriate grounds, which is partly a guarantee of compliance with legal requirements. When applying administrative coercive measures, the relationship between the principles of legality and expediency plays an important role. Legality as a principle of application of administrative coercive measures, on the one hand, combines other principles of application of coercive measures, and on the other hand, the operation of the principle of legality should not replace the work of other principles. |
