| Περιγραφή: | Based on the results of the analysis of the historically manifested features of the emergence and development of domestic criminology and forensic science: the extensive development of the system of scientific and technical support for the disclosure and investigation of crimes in the Soviet era, the specifics of the functioning of the system of forensic institutions of the USSR Ministry of Justice, attention is drawn to the time-consuming and the problems of organization and legal regulation of forensic and forensic activities that have become familiar; there is a negative impact on their development of conflicting relations between law enforcement and law enforcement ministries and departments. The formality of the differentiation of forensic knowledge is noted, without simultaneous differentiation of the organizational and legal forms of their use in the criminal process, taking into account the phased process of investigating crimes. The problems of scientific and technical support of criminal proceedings in the context of digitalisation of social and economic and legal relations are characterized; the necessity of forming a common state system of scientific and technical support of legal proceedings is argued, the system of its principles is determined. Attention is drawn to the fact that the development of the conceptual foundations of such a system should be based on a comprehensive public discussion and involve the search for an optimal solution, taking into account modern achievements in science and technology. На основе результатов анализа исторически проявившихся особенностей возникновения и развития отечественной криминалистики и судебной экспертизы (экстенсивность развития системы научно-технического обеспечения раскрытия и расследования преступлений в советское время, специфика функционирования системы судебно-экспертных учреждений Минюста СССР) обращается внимание на длящиеся во времени и ставшие привычными проблемы организации и правового регулирования экспертно-криминалистической и судебно-экспертной видов деятельности. Отмечается негативное влияние на их развитие противоречивых отношений правоохранительных и правоприменительных министерств и ведомств. Подчеркивается формальность дифференциации криминалистических знаний без одновременной дифференциации организационно-правовых форм их использования в уголовном процессе с учётом поэтапного процесса расследования преступлений. Характеризуются проблемы научно-технического обеспечения уголовного судопроизводства в условиях цифровизации общественных и экономико-правовых отношений; аргументируется необходимость формирования общей государственной системы научно-технического обеспечения судопроизводства, определяются её принципы. Обращается внимание на то, что разработка концептуальных основ такой системы должна базироваться на всестороннем публичном обсуждении и предполагать поиск оптимального решения проблем с учётом современных достижений науки и техники. |
