| Description: | Статья посвящена рассмотрению проблемы определения объектов преступления, предусмотренного статьей 242 Уголовного кодекса РФ «Незаконные изготовление и оборот порнографических материалов или предметов». Авторы отмечают, что ни в уголовно-правовой доктрине, ни в судебно-следственной практике в настоящее время нет единообразного понимания непосредственного объекта данного посягательства. В этой связи с целью актуализации ст. 242 УК РФ вносится предложение об определении нового объекта данного посягательства — духовно-нравственные ценности. The article is devoted to considering the problem of determining the objects of the crime provided for in Article 242 of the Criminal Code of the Russian Federation “Illegal production and circulation of pornographic materials or objects.” The authors note that neither in the criminal law doctrine, nor in judicial and investigative practice there is currently a uniform understanding of the direct object of this attack. In this regard, in order to update Art. 242 of the Criminal Code of the Russian Federation, a proposal is made to define a new object of this encroachment - spiritual and moral values. |
