Description: В статье рассматриваются вопросы правового регулирования социального обслуживания в полустационарных учреждениях и на дому. Автор выделяет два вида правового регулирования (федеральный уровень и уровень субъекта федерации), которые позволяют говорить о единстве и дифференциации в правовом регулировании данных отношений. Автором ставится вопрос о равенстве получателей услуг, о порядке предоставления услуг и их стоимости, которая различается в разных субъектах Федерации и зависит от экономического положения и потребностях населения в подобного рода услугах. На основе анализа действующего в настоящее время законодательства в сфере оказания социального обслуживания определен круг получателей услуг, порядок определения нуждаемости получателя в таких услугах, возможность их бесплатного получения. Автор считает, что гарантированный минимум услуг определяется федеральным законодательством, а разнообразие услуг, предоставляемых субъектами Федерации, может только улучшать правовое положение получателей услуг относительно установленного гарантированного минимума, устанавливаемого на уровне Федерации. Автор исследует вопрос о бесплатном предоставлении социального обслуживания на дому и в полустационарных условиях, который в действующем законодательстве связывается со среднедушевым доходом получателя, определяемым в зависимости от экономических возможностей субъектов Федерации. Что касается среднедушевого дохода, дающего право на бесплатное получение социальной услуги, делается вывод, что в большинстве субъектов Федерации он значительно превышает установленный федеральным законодательством минимум, что свидетельствует об увеличении доступности бесплатных услуг по социальному обслуживанию на дому и в полустационарных условиях The article examines the issues of legal regulation of social services in such forms as semistationary institutions and at home. The author identifies two types of legal regulation (at the federal level and at the level of the federation entities), which allow us to speak of the unity and differentiation of the legal regulation of these relations. The author raises the question of equality of service recipients, the procedure for providing services and their cost, which varies in different regions of the federation and depends on the economic situation and the needs of the population for services. Based on the analysis of the current legislation in the field of social services, the circle of recipients of services, the procedure of determining the recipients need for such services, the possibility of their free receipt is determined. The author believes that the guaranteed minimum of services is determined by the federal law, and the variety of services provided by the federation entity can only improve the legal status of beneficiaries with respect to the established guaranteed minimum. Regarding per capita income, which gives the right to free social services, it is concluded that in most entities of the federation it significantly exceeds the minimum established by the federal legislation, which indicates an increase in the availability of free social services at home and in the semistationary conditions
