В рамках спора застройщик может задержать оплату. Без связывания основным средством правовой защиты для подрядчика является судебный процесс или залоговое удержание. При наличии облигации поручители строительной компании кровно заинтересованы в разрешении конфликта до того, как он достигнет точки использования залога. In the article, the authors investigate the problem of cost overruns in construction. Sometimes the general contractor or developer disputes the percentage of completion, the reason for the delay, or another performance metric stipulated by the contract. As part of a dispute, the developer may delay payment. Without binding, the primary remedy for the contractor is litigation or liens. In the presence of a bond, the guarantors of theconstruction company have a vested interest in resolving the conflict before it reaches the point of use of the collateral. Thus, the insurance company usually intervenes to avoid costly delays and resolve the dispute beforeescalating. |
