Description: In the modern domestic criminal process, the problem of little investigation of the institution of criminal procedural duties of power participants in pre-trial proceedings, as well as its structural element of the mechanism for the performance of these duties, remains urgent. The effectiveness of pre-trial proceedings directly depends on the performance of criminal procedural duties by the authorities. The imperfection of the criminal procedure legislation, the presence of conceptual gaps in the regulation of individual procedural institutions, form the internal problems of the mechanism of performance of duties. The article examines the problems of the mechanism of performance of duties by powerful participants in pre-trial proceedings. The current criminal procedure legislation is analyzed, the system of powers of the power participants is considered, conceptual and normative gaps are identified. The comparative legal characteristics of the current norms and the comparison of the systems of powers of the power participants are carried out. The position of scientists on the mechanism of execution of criminal procedural duties is considered, a vision of the structural elements of the mechanism is formed. The mechanism of execution of criminal procedural duties as a subsystem of the mechanism of legal regulation is analyzed from a conceptual point of view. This study allowed us to form a common vision of the mechanism of execution of criminal procedural duties of its structural elements. The security (criminal procedure terms, criminal procedure form, principles of criminal proceedings, complaints, petitions) and control (judicial and departmental control, prosecutor's supervision) elements and their impact on the functioning of the mechanism for the performance of criminal procedural duties were investigated.
В современном отечественном уголовном процессе остается актуальной проблема малоисследованности института уголовно-процессуальных обязанностей властных участников в досудебном производстве, а также его структурного элемента — механизма исполнения указанных обязанностей. Эффективность досудебного производства напрямую зависит от исполнения уголовно-процессуальных обязанностей властными участниками. Несовершенство уголовно-процессуального законодательства, наличие концептуальных пробелов в регулировании отдельных процессуальных институтов образуют внутрисистемные проблемы механизма исполнения обязанностей. В статье исследуется проблематика механизма исполнения обязанностей властными участниками досудебного производства. Проанализировано действующее уголовно-процессуальное законодательство, рассмотрена система полномочий властных участников, выявлены концептуальные и нормативные пробелы. Осуществлены сравнительно-правовая характеристика действующих норм и сравнение систем полномочий властных участников. Рассмотрена позиция ученых по поводу механизма исполнения уголовно-процессуальных обязанностей, сформировано видение структурных элементах механизма. Проанализирован с концептуальной точки зрения механизм исполнения уголовно-процессуальных обязанностей как подсистема механизма правового регулирования. Данное исследование позволило сформировать общее видение механизма исполнения уголовно-процессуальных обязанностей, его структурных элементов. Исследованы обеспечительные (уголовно-процессуальные сроки, уголовно-процессуальная форма, принципы уголовного судопроизводства, жалобы, ходатайства) и контрольные (судебный и ведомственный контроль, прокурорский надзор) элементы и их влияние на функционирование механизма исполнения уголовно-процессуальных обязанностей.
