Description: Целью исследования является выявление проблем правового регулирования использования систем видеоконференц-связи в арбитражном, гражданском процессе, а также в административном судопроизводстве. Системы видеоконференц-связей являются способом осуществления процессуальных действий; в связи с унификацией процесса они становятся межотраслевыми институтами. Одним из условий применения такой связи является техническая возможность ее осуществления. В статье предлагается законодательно закрепить понятие «техническая возможность осуществления видеоконференц-связи», а также возможность применения систем видеоконференц-связи только для лиц, которые по объективным причинам не могут участвовать в судебном заседании. Выявлено отсутствие в цивилистическом процессе единого подхода к вопросу организации видеоконференц-связи в суде, при содействии которого заявитель участвует в судебном заседании, а также отсутствие в АПК РФ норм, регулирующих участие в судебном заседании посредством использования систем видеоконференц-связи лиц, находящихся в местах содержания под стражей или в местах отбывания наказания в виде лишения свободы, и сделаны предложения по устранению данных пробелов. The aim of the study is to identify problems of legal regulation in the arbitration, civil litigation, as well as in administrative proceedings using video conferencing systems, which is a way of carrying out procedural actions, which often, in the light of the unification of the process, become intersectoral institutions. One of the conditions for the use of such a connection is the technical feasibility of its implementation. The article proposes to legislatively consolidate the concept of "technical feasibility of video-conferencing", as well as to consolidate the possibility of using video-conferencing systems only for persons who, for objective reasons, cannot participate in the hearing. In addition, the study revealed the lack of a unified approach in the civil process to the organization of videoconferencing in court with the assistance of which the applicant participates in the court session, as well as the absence in the APC of the Russian Federation of rules governing participation in the court session through the use of video conferencing systems communication of persons in places of detention or in places of deprivation of liberty and proposals were made to fill these gaps.
