Description: The article analyzes the normative activity of self-regulatory organizations in the field of construction. The author reveals the legal nature of the norms of self-regulation in the field of construction and raises the problem of determining their place in the legal system. It is noted that the rule-making of self-regulating organizations is a collective activity of business entities, the result of which is a corporate act. The author concludes that in order to improve the rule-making activities of self-regulatory organizations in the field of construction, it is necessary to carry out a set of measures and make appropriate changes to the legislation.
В статье анализируется нормотворческая деятельность саморегулируемых организаций в сфере строительства. Автор выявляет правовую природу норм саморегулирования в строительстве и поднимает проблему определения их места в системе права. Отмечается, что нормотворчество саморегулируемых организаций представляет собой коллективную деятельность субъектов предпринимательства, результатом которой является корпоративный акт. Автор заключает, что в целях совершенствования нормотворческой деятельности саморегулируемых организаций в сфере строительства необходимо провести комплекс мероприятий и внести соответствующие изменения в законодательство.
