| Περιγραφή: | В статье рассматриваются теоретические и практические проблемы, связанные с защитой чести, достоинства и деловой репутации граждан, осуществляющих предпринимательскую деятельность, в случае распространения сведений, не соответствующих действительности и порочащих названные нематериальные блага; анализируются правовая сущность данных категорий и критерии их разграничения; исследуется дуализм правового статуса индивидуальных предпринимателей, отражающий социальную и биологическую составляющие в их гражданской правосубъектности; демонстрируется, что отмеченный дуализмом и двойственный характер объекта нарушения обусловливает разграничение подведомственности рассматриваемой категории дел между судами общей юрисдикции и арбитражными судами; выявляются критерии разграничения сведений, порочащих, с одной стороны, деловую репутацию предпринимателя, а с другой — его честь и достоинство; сопоставляются судебные и научные позиции, сформированные относительно возможности компенсации морального вреда, причиненного гражданам-предпринимателям посягательством на принадлежащие им нематериальные блага. На основе проведенного анализа формулируется вывод о том, что положения действующего законодательства, устанавливающие условия и способы защиты чести, достоинства и деловой репутации физических и юридических лиц, в том числе граждан, осуществляющих предпринимательскую деятельность, направлены на решение задачи, поставленной И.А. Покровским: «Помимо охраны человека в его “общей, родовой сущности”, в его типических интересах, дать охрану конкретной личности во всем богатстве ее своеобразных особенностей и проявлений». The article discusses theoretical and practical problems related to the protection of honor, dignity and business reputation of individual entrepreneurs in the event of dissemination of information that does not correspond to reality and encroaches on these intangible benefits; the legal essence of these categories and the criteria for their delimitation are analyzed; the dualism of the civil legal status of individual entrepreneurs is explored, reflecting the social and biological components of their civil legal personality; it is demonstrated that the marked dualism and dual nature of the object of the violation determines the delimitation of the jurisdiction of the category of cases under consideration between courts of general jurisdiction and arbitration courts; criteria are identified for distinguishing information that discredits, on the one hand, the business reputation of an entrepreneur, and, on the other, his honor and dignity; judicial and scientific positions formed regarding the possibility of compensation for moral damage caused to citizen entrepreneurs by encroachment on their intangible benefits are compared. Based on the analysis, a conclusion is formulated that the provisions of the current legislation establishing the conditions and methods for protecting the honor, dignity and business reputation of individuals and legal entities, including citizens engaged in business activities, are aimed at solving the problem set by I.A. Pokrovsky: “in addition to protecting a person in his “general, generic essence,” it is in his typical interests to give protection to a specific personality in all the richness of its unique characteristics and manifestations.” |
