Description: In this article, the author analyzed changes in regulatory requirements for the establishment of separate and combined zones of protection of cultural heritage sites, their obligation and regulatory certainty in the prism of the legislation of the Russian Federation on urban planning, land legislation of the Russian Federation, legislation of the Russian Federation in the field of preservation, use and popularization of cultural heritage sites. The options for law enforcement of previously existing requirements were also considered and analyzed using the example of legal acts of the regions of the Russian Federation. On the basis of the studies carried out, the author indicates the directions for the further development of measures for the state protection of cultural heritage objects, the necessary changes in federal legislation, as well as positive and discussion points in the current version of the Regulation on the protection zones of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation
В настоящей статье автор проанализировал изменения нормативных требований к установлению отдельных и объединенных зон охраны объектов культурного наследия, их обязательность и нормативно-правовую определенность в призме законодательства РФ о градостроительной деятельности, земельного законодательства РФ, законодательства РФ в области сохранения, использования и популяризации объектов культурного наследия. Также рассмотрены и проанализированы варианты правоприменения ранее действовавших требований на примере правовых актов регионов РФ. На основе проведенных исследований автором обозначаются направления дальнейшего развития мероприятий государственной охраны объектов культурного наследия, необходимых изменений федерального законодательства, а также положительные и дискуссионные моменты в действующей редакции Положения о зонах охраны объектов культурного наследия (памятников истории и культуры) народов РФ
