| Description: | С 1 июля 2019 года в правовую систему России был включен новый институт наследственного права — институт наследственного договора. Многие аспекты этого института не получили своего полного раскрытия, правоприменительная практика наследственного договора только начинает складываться. Институт наследственного договора имеет иностранные корни, и его имплементация в правовую систему России предполагает анализ проблем его применения в тех странах, где он получил правоприменительную практику, и прежде всего в Германии. На основе анализа проблемных аспектов законодательного регулирования наследственного договора автор делает предложения по совершенствованию его правового регулирования. Since 1 July 2019, a new institution of inheritance law - the institution of inheritance contract - has been included in the Russian legal system. Many aspects of this institution are not yet fully developed, the regulations of the inheritance contract are only just beginning to be applied in legal practice. The institution of inheritance contract has foreign roots, its implementation in the Russian legal system implies the need to analyze the problems of their application in the countries (mainly Germany) where these institutions have developed and are already applied in practice. This analysis provides the basis for suggestions regarding the improvement of the legal regulation of the institution of the inheritance contract in Russia. |
