| Description: | Without determining rather specific organizational and tactical aspects of work with the persons giving confidential assistance and cooperation to the bodies carrying out detective activity on the territory of the Russian Federation due to the attribution of this information to that one that constitutes the state and official secrets the given article analyzes the provisions of current open regulatory legal acts regulating the implementation of detective and search activity in chamber-type premises in the special institutions of the Interior Ministry of Russia. Namely, the issues that reveal the legal basis for staying the specific detainees (arrested) men and other categories of persons on the legal grounds in conditions of isolation from the society. At the same time the article deals with not only the declarative nature of certain international regulatory legal acts that are international treaties and, as a result, an integral part of the legal system of the Russian Federation, but also the impossibility of their practical application due to the fact that a number of decisions of interstate bodies, adopted on the basis of the provisions of international treaties of the Russian Federation in their interpretation contradict the Constitution of the Russian Federation. Taken together this shows the existing problems of implementing the principle of legality in detective activity. Taking it into account, the specific options to solve the mentioned issues by studying the system of legislative acts regulating the implementation of detective activity in chamber-type premises in the special institutions of the Interior Ministry of Russia are proposed. В статье без освещения достаточно специфичных организационно-тактических аспектов работы с лицами, оказывающими конфиденциальное содействие и сотрудничество органам, осуществляющим оперативно-разыскную деятельность на территории Российской Федерации, в силу отнесения указанной информации к сведениям, составляющим государственную и служебную тайны, проанализированы положения действующих открытых нормативных правовых актов, регламентирующих вопросы осуществления оперативно-разыскной деятельности в помещениях камерного типа в специальных учреждениях МВД России. Речь идет о вопросах, раскрывающих правовую основу нахождения конкретных задержанных (арестованных) и иных категорий лиц на законных основаниях в условиях изоляции от общества. В то же время в статье обращено внимание не только на декларативность отдельных международных нормативных правовых актов, являющихся международными договорами и как следствие — составной частью правовой системы Российской Федерации, но и на невозможность их практического применения в связи с тем, что ряд решений межгосударственных органов, принятых на основании положений международных договоров Российской Федерации, в их истолковании противоречат Конституции Российской Федерации. В совокупности это свидетельствует о существующих проблемах реализации принципа законности в оперативно-разыскной деятельности. С учетом сказанного предложены конкретные варианты разрешения обозначенной проблематики путем изучения системы законодательных актов, регламентирующих вопросы осуществления оперативно-разыскной деятельности в помещениях камерного типа в специальных учреждениях МВД России.
