| Περιγραφή: | В статье проводится анализ генезиса принципа состязательности в цивилистическом процессе. Автор на основе исследования российской исторической и современной доктрины права, а также иностранной доктрины права, правовых положений Европейского суда по правам человека предлагает свое понимание содержания исследуемого принципа. Автор показывает различное содержание принципа состязательности в цивилистическом процессе, административном судопроизводстве и уголовном процессе. The article analyzes the genesis of the principle of competition in the civil process. The author, based on a study of the Russian historical and modern doctrine of law, as well as foreign doctrine of law, legal provisions of the European Court of Human Rights, offers his understanding of the content of the principle under study. The author shows the different content of the principle of competitiveness in the civil process, administrative proceedings and criminal proceedings. |
