| Description: | В статье анализируются и обобщаются правила назначения наказания при рецидиве за преступления, наиболее строгим наказанием за которые является пожизненное лишение свободы или смертная казнь. Вычислены суммарные коэффициенты, облегчающие определение максимума и минимума возможного наказания в случае применения ст. 68 Уголовного кодекса РФ совместно с другими специальными правилами назначения наказания, влияние которых на наказание формализовано в законе. Определены максимальные и минимальные значения наказания для различных случаев применения указанных норм по рассматриваемой категории дел. The article analyzes and summarizes the rules of sentencing in case of recidivism for crimes, the most severe punishment for which is life imprisonment or the death penalty. The total coefficients that facilitate the determination of the maximum and minimum of possible punishment in the case of the application of Article 68 of the Criminal Code of the Russian Federation together with other special rules of sentencing, the impact of which on punishment is formalized in the law, are calculated. The maximum and minimum values of punishment for various cases of application of these norms in the category of cases under consideration are determined. |
