| Description: | The features of establishing psychological contact with the interrogated person claiming to have committed actions in a state of necessary defense (excess defense) are considered. It is indicated that at the initial stage of the interrogation it is important to establish communication with the interrogated person, since the effectiveness of the investigative action depends on it. In this regard, it is necessary to assess the psychological state of the interrogated person, to determine his psychological type. The beginning of the interrogation is preceded by the «free story» stage, which also helps to establish psychological contact. The investigator, pursuing the goal of maximum detail, must establish the circumstances concerning the moment of the beginning and end of the socially dangerous encroachment from which the person was defending; the place and time of the socially dangerous encroachment, the number of attackers, the type of weapons used by them or objects used as weapons; the nature and reality of the threat of socially dangerous encroachment; about previous conflicts, facts of acquaintance with the attacker , etc . There are also other circumstances that need to be clarified by the investigator during the initial and subsequent interrogations of a person, including in cases of changes in the initial testimony. Рассматриваются особенности установления психологического контакта с допрашиваемым лицом, заявляющим о совершении им действий в состоянии необходимой обороны (эксцесса обороны). Указывается, что на начальной стадии допроса важно наладить коммуникацию с допрашиваемым лицом, так как от нее зависит результативность следственного действия. В связи с этим необходимо оценить психологическое состояние допрашиваемого лица, определить его психологический тип. Начало допроса предваряет стадия «свободного рассказа», также помогающая установить психологический контакт. Следователь, преследуя цель максимальной детализации, должен установить обстоятельства, касающиеся момента начала и окончания общественно опасного посягательства, от которого оборонялось лицо; места и времени общественно опасного посягательства, количестве нападающих, виде применяемого ими оружия или предметов, используемых в качестве оружия; о характере и реальности угрозы общественно опасного посягательства; о предшествовавших конфликтах, фактах знакомства с нападающим и др. Отмечаются и другие обстоятельства, которые необходимо выяснять следователю при первоначальных и последующих допросах лица, в том числе и в случаях изменения первоначальных показаний. |
