Description: Статья посвящена актуальным на сегодня вопросам исчисления процессуальных сроков и применения реальных сроков в процедуре банкротства физических лиц. Одним из основных факторов роста числа банкротств физических лиц является переход на удаленную работу в 2020—2021 годах, а также финансовая неграмотность физических лиц. Изучению подлежат сроки, применяемые на всех этапах процедуры банкротства: на стадии подготовки заявления о банкротстве, принятия заявления к производству судом, рассмотрения обоснованности заявления о несостоятельности в суде, а также сроков непосредственно в процедурах реализации имущества и реструктуризации долга. В своем исследовании авторы делают акцент на конкретных обстоятельствах и факторах, влияющих на увеличение сроков процедуры банкротства. Проведен сравнительный анализ действующего законодательства в части процедурных сроков и сроков, фактически применяемых в процедуре банкротства физических лиц. This article is devoted to the calculation of procedural and the application of real terms in the bankruptcy procedure of individuals. This topic is relevant in modern realities. One of the main factors of the growth of bankruptcy of individuals is the transition to remote work in 2020-—2021, as well as financial illiteracy of individuals. The terms applied at all stages of the bankruptcy procedure are subject to study: at the stage of preparing a bankruptcy application, acceptance of the application for production by the court, consideration of the validity of the insolvency application in court, as well as the timing directly in the procedures for the sale of property and debt restructuring. In this study, the authors focus on specific circumstances and factors affecting the extension of the bankruptcy procedure. Also, a comparative analysis was carried out between the current legislation in terms of procedural terms and the terms actually applied in the bankruptcy procedure of individuals.
