Περιγραφή: В рамках научной дискуссии, в качестве практического применения системообразующих элементов гражданского и трудового права дается оценка проекту Федерального закона «О частной охранной деятельности». Последовательно выявляются и анализируются проблемные аспекты законопроекта, обусловленные отсутствием должного учета теоретических и практических положений о предмете, методе, принципах, источниках как фундаментальных основах частного права. Обосновывается вывод о том, что законопроект как зеркало отражает в себе проблемы, созданные игнорированием вышеперечисленных правовых основ, которые в случае их неустранения могут привести к негативным последствиям в исследуемой сфере правового регулирования. Аргументируется положение о том, что вместо акта гражданского законодательства и «федерального закона, содержащего нормы трудового права» законопроект по своей сути представляет административный регламент федерального органа исполнительной власти, наделенного соответствующими контрольным и надзорными функциями. Статья может быть использована в качестве методологического аспекта, востребованного при разработке проектов законов и иных правовых актов в области гражданского, предпринимательского и трудового права. Within the framework of the scientific discussion, as a practical implementation of the system-forming elements of civil and labor lawthe draft Federal Law «On Private Security Activity» is evaluated. The problematic aspects of the draft law are consistently identified and analyzed due to the lack of due consideration of theoretical and practical provisions on the subject, method, principles, sources as the fundamental foundations of private law. The conclusion is substantiated that the draft law as a mirror reflects the problems created by ignoring the above-mentioned legal foundations, which, if they are not removed, can lead to negative consequences in the sphere of legal regulation under study. The position is argued that instead of an act of civil legislation and a «federal law containing labor law norms», the bill essentially represents the administrative regulations of a federal executive authority endowed with appropriate control and supervisory functions. The article can be used as a methodological aspect in demand in the development of draft laws and other legal acts in the field of civil, business and labor law.
