Description: The aim of this chapter is to explore how Rawls’s theory of justice might be used to address issues of disability accommodations. Investigating the details of Rawls’s theory of justice with the problem of disability accommodations squarely in mind reveals a complex and troubling account of this core aspect of disability justice. When the problem of disability accommodations is framed within Rawls’s theory, the proper distribution of disability accommodations by the basic structure of society is a central part of the problem of justice that Rawls designed his framework to address at its highest level. Examining what Rawls’s principles of justice imply about the problem of disability accommodations, one finds that such accommodations are only partially secured by the difference principle rather than by any of his other more basic principles of justice. Also, the difference principle contingently, indirectly, and inadequately secures such accommodations for people with disabilities in ways that undermine the social bases of self-respect. In short, without a firmer basis in Rawls’s principles of justice, it is unlikely that a fully just Rawlsian society would enact anything close to the Americans with Disabilities Act, which mandates many disability accommodations for disabled people throughout the United States. This is a disturbing implication, but the chapter ends with three minor amendments to Rawls’s principles of justice that offer a promising path for addressing the problem of disability accommodations within Rawls’s theory of justice.
