| Description: | Исследуются формы непосредственного участия граждан Российской Федерации в осуществлении публичной власти, представленные на трех уровнях власти. Проведен сравнительно-правовой анализ таких форм осуществления народовластия на федеральном уровне, как референдум и общенародное голосование; выявлены схожесть и различия указанных институтов. Исследованы отдельные институты прямой демократии на местном уровне, такие, как правотворческая инициатива граждан, а также голосование по отзыву депутатов или должностных лиц органов местного самоуправления. Авторы делают вывод о наличии пробельности и дефектах законодательства относительно институтов непосредственного осуществления народовластия в Российской Федерации. The article studies the forms of direct participation of citizens of the Russian Federation in the exercise of power: the forms presented at three levels of public authority are studied. A comparative legal analysis of such forms of the exercise of democracy at the federal level as a referendum and popular vote has been carried out; revealed the similarities and differences of these institutions. The institutions of direct democracy at the local level have been sufficiently investigated, to which the authors refer to a local referendum, a law-making initiative of citizens, as well as voting to recall deputies or officials of local self-government bodies. Conclusions are made about the gap and defectology of legislation regarding the institutions of direct implementation of democracy in the Russian Federation. |
