Abstract (English): The article analyzes the Digital Omnibus initiative of the European Commission, which aims to simplify European digital and data law and create a uniform legal framework for the data protection-compliant processing of personal data in the training and operation of artificial intelligence (AI). The focus is on three central regulatory proposals: Art. 88c GDPR-E (General Data Protection Regulation), Art. 9 para. 2 lit. k in conjunction with para. 5 GDPR-E, as well as Art. 4a of the AI Digital Omnibus Regulation (AI-VO-E). The analysis shows that, in particular, Art. 9 para. 5 GDPR-E exhibits significant deficiencies, as it inadequately safeguards the protection of sensitive data and constitutes an overly broad exception to the processing prohibition. Overall, it is emphasized that despite efforts to promote innovation and competitiveness, the data protection standard of the GDPR must be maintained, whereby a risk-based approach to regulating AI data processing is sensible but must be carefully designed to effectively protect fundamental rights. Abstract (German): Das Paket VII des Digital-Omnibus-Vorhabens der Europäischen Kommission verfolgt das Ziel, das zersplitterte europäische Digital- und Datenrecht zu vereinfachen und zugleich die Datennutzbarkeit für die Entwicklung vertrauenswürdiger KI‑Technologien zu verbessern. Im Zentrum dieses Beitrags steht die kritische Analyse dreier Regelungsvorschläge, die - verteilt auf die Entwürfe für eine Digital-Omnibus‑VO und eine KI‑Digital- Omnibus‑VO - gemeinsam eine Rechtsgrundlage für die Verarbeitung personenbezogener Daten bei Entwicklung und Betrieb von KI‑Systemen schaffen sollen: Art. 88c DSGVO-E, Art. 9 Abs. 2 lit. k i.V.m. Abs. 5 DSGVO‑E sowie Art. 4a KI‑VOE. Der Beitrag untersucht, ob die Vorschläge im Zusammenspiel das KI‑Training mit personenbezogenen Daten angemessen regeln und dabei das bestehende Schutzniveau der DSGVO wahren. Besonderes Augenmerk gilt der Vereinbarkeit mit dem Verarbeitungsverbot besonderer Kategorien personenbezogener Daten gem. Art. 9 DSGVO sowie der Kohärenz der unterschiedlichen Wertungsmaßstäbe. Die Untersuchung zeigt, dass insbesondere Art. 9 Abs. 5 DSGVO‑E in seiner derzeitigen Fassung erhebliche Defizite aufweist und einer Anpassung bedarf, um den grundrechtlichen Anforderungen des europäischen Datenschutzrechts gerecht zu werden.
