| Περίληψη: | The purpose of this article is to analyze the impact of the General Data Protection Regulation (GDPR) on the use of modern forensic identification technologies based on artificial intelligence for facial recognition, fingerprints and DNA profiles comparison in the context of criminal investigations. The article examines how GDPR regulations influence the processing of biometric data, highlighting the legal, ethical, and operational challenges associated with these technologies. The study explores the fundamental principles of GDPR, including legality, transparency, and data minimization, critically analyzing how these rules restrict or permit the use of biometric data in criminal investigations. It also addresses the exemptions provided by GDPR, particularly Article 9 concerning the processing of sensitive data and Article 23, which allows for the limitation of certain rights to protect national security and prevent serious crimes. The research method employed involves a doctrinal analysis of GDPR regulations, relevant case studies (both international and Romanian), and the jurisprudence of the Court of Justice of the European Union. The article explores specific challenges related to facial recognition, DNA data storage, and the risks of algorithmic discrimination, emphasizing the conflicts between privacy protection and public security needs. The conclusions highlight the necessity of balancing security and fundamental rights, recommending best practices for the use of identification technologies under the GDPR framework. The article underscores the importance of conducting Data Protection Impact Assessments (DPIAs) and fostering collaboration between data protection authorities and law enforcement agencies to ensure the safeguarding of privacy and fundamental freedoms in the digital era.
